ESTATE PLANNING AND TRUSTS

Protecting Your Assets Through Estate Planning And Trusts

Estate Planning is the process where a person develops a plan and prepares documents to conserve, protect, and distribute their assets before, and after, death for the benefit of their loved ones and charities. It'll take into consideration the effect of state and federal tax, and administrative laws and regulations.

It may also involve planning for the use of your assets if you unfortunately become unable to oversee and manage your affairs during your lifetime. If you own a home, have savings in the bank, or own hard goods such as a car, boat, plane or furniture, then you have what is considered an estate.

Planning for the future will affect the financial security of your loved ones. If you don't plan for what will happen to your estate upon your death, the government will make those decisions for you.

An estate plan is important if:

  • You care who will inherit your property;
  • You care about health care treatment;
  • You are the parent of minor or disabled children; and/or
  • You'd rather avoid the public proceedings of a possible guardianship and/or probate.

To achieve your estate planning objectives, an estate planning attorney will make recommendations based on a comprehensive review of your assets and general situation, and your personal goals. The attorney will investigate and analyze your estate, including your business organization and financing structures, and learn as much as they can about you and your family.

Next, they will help you refine your estate planning objectives and provide you with what they think will be the most effective means of achieving those objectives. It may include prudent tax and asset protection planning. For complex estates, they will schedule a number of meetings to develop a customized estate plan which may involve the formation of Family Limited Partnerships and Charitable/Private Foundations.

Following the initial conference, you will receive drafts of your estate plan documents.You and your estate planning lawyer will have a telephone conference to review your documents in detail, explaining what each document does and how the documents interact with each other. You will then visit their office to have your “Signing Ceremony.” Once your documents are signed, the estate planning attorney will provide you with the original estate plan documents and an “Estate Planning Portfolio”.

This portfolio will not only contain a copy of all of your estate planning documents which were prepared for you, but also vital information for you and your family’s use. You will then be assisted with a very important aspect of estate planning- the “Funding Phase” to ensure your estate plan works for you.

The Funding Phase is where you will transfer your assets to your Revocable Living Trust. Your most valuable assets must be titled with the Trust’s name for the trust to be of any benefit to your heirs.
